Argentina

  • It is a country that belongs to South America.

Gastronomy

Surrogacy in Argentina

  • In Argentina there is no law regulating surrogacy, but it is authorized and approved by Article 19 of the National Constitution.
  • This article also allows homosexual couples to become parents, since Argentina was the first country to fully recognize the homoparental family.
  • To do this, the surrogate must renounce her rights as a mother and acknowledge the paternity of one of the intended parents, and her partner then adopts the baby.
  • The project presented in 2011 envisages the legalization of surrogacy and although it is not envisaged, it is not sanctioned either.
  • To carry out the process, the surrogate and the future parents will sign an informative consent and request its homologation in court.
  • Once the child is born, filiation will be made by court order. It will be necessary to confirm that the surrogate has no genetic link with the baby.
  • The Civil Code provides protection, as it incorporates the will to procreate, which is the basis for the baby to be recognized as a child of the intended parents

Surrogates in Argentina must meet the following requirements:

  • Be of legal age.
  • Having given birth to their own child.
  • Cannot act as surrogates more than twice.
  • Cannot bring their gametes.
  • Must pass medical and psychological tests proving that they have full capacity to act and good physical and mental health.
